Moti Network reserves the right to suspend or cancel a customer's access to any or all services provided by Moti Network when Moti Network decides that the account has been inappropriately used or otherwise.

SERVER USE
Moti Network reserves the right to refuse service and /or access to its servers to anyone. Moti Network do not allow any of the following content to be stored on its servers:

Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation.

Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of Moti Network.

Warez - Includes pirated software, ROMS, emulators, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

Spamming - Unsolicited, commercial mass e-mailing (known as "spamming") is a strongly disfavored practice among Internet users and web hosting providers. It is particularly harmful not only because of its negative impact on consumer attitudes toward us, but also because it can overload our equipment and disrupt service to our customers. This includes listing a hosted domain in any unsolicited email.

BACKUP POLICY
Clients are responsible for their web site backups as well as emails. They must download their emails by Outlook Express or any other email client on to their computer hard disk. We can't take any data responsibility for client emails or web site data. However we take backup for our server restoration in case of server hard disk failure but this is for our own administration purpose. The clients are responsible to upload their data at first time (when we create their web hosting account on our servers) and any other time if any misshapen happened.

HIGH RESOURCE USER POLICY
Resources are defined as bandwidth and/or processor utilization.
Moti Network may implement the following policy to its sole discretion:
When a website is found to be monopolizing the resources available Moti Network reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers.

REFUNDS

All Web Hosting plans include 24 hours money back guarantee. If you are dissatisfied with our service and we are not able to provide what we promised, you will receive a full refund.

Any request for cancellation must be received via the web form, Phone or E-mail and you will receive a confirmation upon the cancellation of your account. No refunds are available after 24 hours.

Accounts cancelled/terminated by Moti Network for violating our Terms of Use do not qualify for the 24 hours money back guarantee. For example, if your account is cancelled due to spamming, you will not be given any refund.

Customer refund requests are to be sent via email or phone within 24 hours from service purchase date and will only be processed in the cases of service non-performance or corruption that might be caused by Moti Network's side, Refund requests will not be accepted if it's requested for any cause that's out of Moti Network's side, For example:

Failure of any third party programs that's not supported by Moti Network's.
Customer's leakage of experience dealing with web basics and communication protocols.

INDEMNIFICATION
Customer agrees that it shall defend, indemnify, save and hold Moti Network harmless from all liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Moti Network, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Moti Network against liabilities arising out of;
(1) any injury to person or property caused by any products sold or otherwise distributed in connection with Moti Network' server;
(2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party;
(3) copyright infringement and
(4) any defective products sold to customer from Moti Network' server.

DISCLAIMER
Moti Network will not be responsible for any damages your business may suffer. Moti Network makes no warranties of any kind, expressed or implied for services we provide. Moti Network disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, non deliveries, wrong delivery, and any and all service interruptions caused by Moti Network and its employees. Moti Network reserves the right to revise its policies at any time.
